1. Terms of Use

   1. These terms of use (together with the documents referred to in it) tells you the terms of use on which you may make use of our website www.gcgra.gov.ae ("our site"). Use of our site includes accessing, browsing, or otherwise using the e-services provided on or via our site.
   2. Please read these terms of use carefully before you start to use our site as these apply to your use of our site.
   3. By using our site, you confirm that you accept these terms of use and that you agree to comply with them.
   4. If you do not agree to these terms of use, you must not use our site.
      
      

2.  Privacy

   1. For information on how we collect and use your personal information please see our Privacy Policy. We will only use your personal information as set out in our Privacy Policy, which is incorporated by reference into these terms of use and forms part of it.

3. Information About Us

   1. Our site is a website owned and operated by the General Commercial Gaming Regulatory Authority (“GCGRA”, ‘"we", "us" or "our"). We are the federal authority for the regulation, supervision and enforcement of commercial gaming in the United Arab Emirates (“UAE”).
      
      

4.  Changes to these Terms

   1. We may unilaterally revise these terms of use at any time without advance notice. Modified terms of use will take effect once posted on the site, unless otherwise stated. Please check this page from time to time to take notice of any changes made as they are binding on you and your continued access. Use of the site after any modification is deemed to be your acceptance of the modified terms of use. 
      
      

5. Changes to our Site

   1. We may update our site from time to time and may change the content at any time without advance notice. Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up-to-date.
      
      

6. Accessing our Site

   1. Our site is made available free of charge.
   2. We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our site without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period.
   3. You are responsible for making all arrangements necessary for you to have access to our site.
   4. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them. 
      Our site is directed to people residing in the UAE. We do not represent that content available on or through our site is appropriate or available in other locations. We may limit the availability of our site or any service or product described on our site to any person or geographic area at any time. If you choose to access our site from outside the UAE, you do so at your own risk and we do not guarantee that our site will be available. 
      
      

7. Your use of our Site

   1. In using our site, you agree that you shall not:
      1. use our site to do anything to encourage, procure or conduct any unlawful;
      2. use our site to engage in any conduct or encourage others to engage in any conduct that would give rise to civil liability;
      3. use our site for any purpose other than your personal use or internal business purposes;
      4. use our site for any purpose that is against any law or do anything which may give rise to or cause us to incur any liability;
      5. email, transmit, post or otherwise disseminate any content, material or information which is, in our sole opinion, defamatory, obscene, offensive, vulgar or indecent or may have the effect of being harassing, threatening, abusive or hateful or that otherwise degrades or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability or is otherwise unlawful;
      6. post any content or material that infringes or violates the intellectual property rights of any third party or do, cause or permit anything to be done that may infringe, damage or interfere with our, or our affiliates’, intellectual property rights;
      7. advertise or promote third party or your own products or services, including by way of the distribution of 'spam' email;
      8. introduce any viruses, trojans or other harmful programs to the site;
      9. access or attempt to access the accounts of other users or penetrate or attempt to penetrate our site's security measures; or
      10. do anything which could or might damage, interfere with, disrupt access to, interrupt or impair the functionality of or the material available on our site.  
   2. If we consider that you have breached any of these terms of use or have otherwise demonstrated inappropriate conduct when using the site, we reserve the right to:
      1. without prior notice to you, remove or delete any material or content that you may have posted;
      2. suspend, restrict or terminate your access to our site at any time without notice at our discretion; 
      3. report you to an internet service provider and/or any relevant regulatory body or authority; and/or
      4. take legal action against you.
         
         

8. Your Account and Password

   1. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.
   2. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use. 
   3. If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us via our contact us page.
      
      

9. Intellectual Property Rights

   1. We are the owner or the licensee of all intellectual property rights in our site and the material published on it.
   2. You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site
   3. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
   4. Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.
   5. You must not use any part of the content on our site for commercial purposes without obtaining a licence to do so from us or our licensors.
   6. If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
   7. When you upload or post content to our site, you automatically grant to us a perpetual, irrevocable, royalty-free, worldwide and non-exclusive licence to use, store, copy and distribute such content as we may determine, acting reasonably.
   8. You represent and warrant that:
      1. you own or control all rights in and to any content you upload or post to our site and you have the right to grant the licence granted to us pursuant to section 9(g) of these terms of use, to us and [our affiliates and service providers, and our respective licensees, successors and assigns]; and
      2. all and any content you upload or post to our site do and will comply with these terms of use.
         
         

10. No Reliance on Information 

    1. The content on our site is provided on an "as is" basis and is for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site.
    2. We do not guarantee that our site, or any content on it, will be free from errors or omissions.  
       
       

11. Limitation of our Liability

    1. Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
    2. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied. 
    3. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with: 
       1. use of, inability to use, or failure of performance of, our site;
       2. use of or reliance on any content displayed on our site; or
       3. any virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it.
          
          
    4.  We will not be liable for any consequential loss, loss of profits, loss of data or loss of sales, business, or revenue, in each case whether direct or indirect.
    5. If you are a consumer user, please note that we only provide our site for non-commercial use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
    6. We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it
    7. We assume no responsibility for the content of websites linked on our site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.
    8. Subject to the clauses herein, our aggregate liability in contract, tort (including negligence or breach of statutory duty) misrepresentation or otherwise in connection with these terms of use shall not exceed AED500.
       
       

12. Indemnity 

    1. You agree to defend, indemnify and hold on demand us and our affiliates harmless from and against all claims, actions, damages, losses, liabilities, costs (including legal fees on a full indemnity basis), expenses or payments whatsoever, which we or our affiliates suffer, incur or are liable for, arising out of or in connection with (i) your use of our site; (ii) any content you post or upload to our site; or (iii) your breach of these terms of use. You agree to fully cooperate in the conduct and defence of any such claim, at our request. You agree to provide all support reasonably requested by us in connection with any such claim. We reserve the right to assume, at its own expense, the sole and exclusive defence and control of any such claim.
       
       

13. Viruses

    1. We do not guarantee that our site will be secure or free from bugs or viruses.
    2. You are responsible for configuring your information technology, computer programmes and platform in order to access our site. You should use your own virus protection software. 
    3. You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
       
       

14. Linking to our Site 

    1. You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
    2. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. 
    3. You must not establish a link to our site in any website that is not owned by you. 
    4. Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page.
    5. We reserve the right to withdraw linking permission without notice. 
    6. If you wish to make any use of content on our site other than that set out above, please contact us. 

15. Third Party Links and Resources in our Site 

    1. Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only.
    2. We have no control over the contents of those sites or resources
       
       

16. Waiver

    We both agree that our rights and your rights under these terms of use:

    1. may be exercised as often as necessary; 
    2. are cumulative and not exclusive of rights or remedies provided by law; and 
    3. may be waived only in writing and specifically. 
       
       

    Delay in exercising or non-exercise of any such right is not a waiver of that right.

17. Entire Agreement

    1. These terms of use, and the policies incorporated into it by reference, contain the entire agreement between you and us relating to its subject matter.
       
       

18. Governing Law and Courts

Please note that these terms of use, its subject matter and its formation, are governed by the laws of the Abu Dhabi Global Market (“ADGM”) as applicable in the ADGM. We both agree to submit to the exclusive jurisdiction of the courts of ADGM.
